Terms and Conditions of Use

Welcome to the terms and conditions for access to and use of your World Rugby fan account, which is owned and operated by World Rugby Limited and/or its associated World Rugby companies, their subsidiaries, affiliates and/or related companies ("World Rugby"). The World Rugby fan account is maintained as a service to its users and fans, subject to the following terms and conditions concerning the use of the fan account.

The purpose of these Terms and Conditions of Use (the “Terms”) is to confirm and outline the rights, obligations, restrictions, conditions and liabilities that shall apply to all use of the fan account by all users and fans.

The Fan Account

The creation and use of your World Rugby fan account is via the enablement of World Rugby’s single sign-on service (SSO) – a user authorisation and identification service. Your fan account will enable you to use many of the World Rugby websites and platforms that use SSO without having to create a new account or register again with each website or platform.

By creating and using a fan account, you agree and acknowledge that any activities conducted under your fan account shall be your sole responsibility and World Rugby shall not be liable for any fraudulent or unauthorised use of or access to your fan account.     

Additional Terms and Conditions - World Rugby Websites and Platforms

These Terms apply to your use of and access to your fan account. For the avoidance of any doubt, use of World Rugby’s websites and platforms shall be governed by separate terms and conditions of use (available on each website and platform) which shall also apply to you and you should consult those terms and conditions prior to using any such websites or platforms.  

Acceptance
You are entitled to access and use your fan account subject always to these Terms. Please ensure to read these Terms carefully prior to creation and use of your fan account.

By creating your fan account and using any functionalities or services within your fan account, you confirm your agreement with, understanding and acceptance of, these Terms and all information pertaining to both your fan account and any material or content on it. If you do not agree to accept these Terms, you do not have permission to access your fan account and you must cease using the account immediately. In addition, when using particular services or functionalities made available via the fan account, you may be subject to additional guidelines, rules or terms applicable to such services or functionalities. All such guidelines, rules or additional terms are hereby incorporated by reference into these Terms.

By using the fan account, you acknowledge and agree that these Terms shall form a legally binding and enforceable contract with you.

Modifications and Acceptance
We reserve the right to change these Terms at any time without notice to you by posting any such changes or updated Terms within your fan account. In such circumstances, the current Terms shall be terminated and shall be replaced by the new Terms and shall immediately apply from the date referenced in the “Last Updated” section below. You are responsible for reviewing regularly the information provided within your fan account in order to obtain timely notice of any such changes. Your continued and/or subsequent use of your account following any such changes shall constitute your acceptance of any such updated or modified Terms.

No Offer of Service
Unless otherwise expressly stated, the material and content accessed on or via your fan account is for information purposes only. We make no representation that material or content accessed via your account (including while using any World Rugby website or platform) is appropriate,  accurate, reliable or available for use in any particular jurisdiction.

All users or fans who choose to access and use the fan account do so at their own risk and such users and visitors are solely responsible for their compliance with local laws and regulations.

Intellectual Property
All and any collaterals, items and materials, and all intellectual property rights contained therein and within your account, including without limitation copyrights, patents, design rights, trade secrets, know-how, confidential information rights, logos, style, look and feel, trade marks, trade names, domain names, service marks, moral rights and database rights contained on or within your fan account (or on any World Rugby website or platform accessed via your account), including without limitation, branding, logos, marks, designs, images, wording and texts, sounds and recordings, documents, statistics, databases, content (moving and still) and all such other materials are exclusively owned by and/or are the exclusive property of World Rugby and/or its licensors, or are otherwise used by World Rugby as permitted by applicable law. Furthermore, all rights in company names, trade names, logos, product packaging and designs of World Rugby, or World Rugby sponsors, licensees, suppliers, or other third-party products or services, belong exclusively to World Rugby or such third-parties, as applicable, or their respective owners, and are strictly protected from reproduction, imitation, dilution or confusing or misleading uses under national and international laws, as applicable.

The use or misuse of any such intellectual property rights, trade marks or any materials or collaterals, except as permitted herein and including without limitation use as a domain name or as part of a domain name, is expressly prohibited and nothing stated or implied on your fan account (or on any World Rugby website or platform) confers on you any licence or right under any patent, copyright work, trade mark, design or other right of a similar nature of World Rugby or any third party.

You are not authorised to use your account or use any collateral, materials or intellectual property rights contained within or related to your account for any purpose other than your own general information purposes or for activities or functionalities made available via your account. You are strictly prohibited from duplicating, modifying, changing, transferring or transmitting, creating derivative works, reverse-engineering, selling, licensing, reproducing, and/or exploiting in any way any materials, content or collaterals or intellectual property rights contained within or available via your fan account.

Any infringement of this provision or breach of World Rugby’s intellectual property rights shall constitute a material breach of these Terms and World Rugby may pursue any action it sees fit, including legal action against you, to immediately cease any such breach or infringement and claim damages in the event of such an infringement, or where damages are not a suitable remedy, seek injunctive action against you.

Nothing stated or implied within your fan account, or as a result of you creating and/or using your account, is designed to grant any licence or right under any copyright or other intellectual property rights of World Rugby or any third party or to grant the use of any names, logos, pictures, trade marks or other works or content featured within your account or on any World Rugby website of platform accessed using your account, unless otherwise expressly stated. No act of downloading or otherwise copying or reproducing from your account will transfer title to you to any software or material from your account, unless express written statements are communicated to you to the contrary by World Rugby.

Use in Compliance with the Terms

When using and/or accessing your fan account, you confirm and undertake that you will comply and adhere to a) these Terms, b) all applicable laws that might apply to you in any jurisdiction and c) World Rugby’s intellectual property rights outlined in this Agreement or under applicable law (including in particular, non-infringement of such rights).

Restricted Use

Without prejudice to any other restrictions in these Terms, you shall not, when creating, using or maintaining your fan account:

• Engage in any illegal, fraudulent or misleading conduct or activities, including the sharing of illegal, fraudulent or misleading content and/or communications or information;
• Distribute or circulate spam or phishing communications;
• Seek unauthorised access to your account, to any other fan account or to any World Rugby website or platform and you shall not attempt to disseminate trojan horses, viruses, bugs or malware into the account or its servers;
• Share explicit or inappropriate content or material (including criminal materials, violent , obscene, hateful or offensive content);  
• Engage in any activity that infringes the intellectual property rights of any third parties;
• Engage in any conduct that violates, or may result in the violation of, the privacy rights of third parties, including in relation to any personal information of any such third parties.  

Own Non-Commercial Use
You may view, download, and print contents from your account subject to the following conditions: (a) the content may be used solely for information purposes and for your own personal non-commercial private use; and (b) the content may not be modified, adapted or altered in any way. You may not copy, store in any medium (including without limitation on any other website), modify, adapt, spider (i.e. use a computer programme to collect or aggregate material from your account), publish, distribute by any means (including without limitation via any peer-to-peer networks such as torrents), prepare derivative works from, broadcast, communicate to the public or transmit any part of your account, website or platform or any of the material contained within those platforms or otherwise use the content for any other purpose other than as explicitly permitted herein. Any other use requires the prior written permission of World Rugby. Without prejudice to the generality of the foregoing, the prohibitions set out in this paragraph apply without limitation to any audio recording or commentary, visual or audio-visual works (whether live, delayed or recorded), data, statistics, live scoring services, text commentary services, reviews, articles, trade marks, logos or photographs (or any part of any of the foregoing) that appear within or are accessed via your account.

You may not frame or use framing techniques to enclose any trade mark, logo, content or other proprietary information or content (including images, text, page layout, or form) of World Rugby or from your account without the express written consent of World Rugby. Without prejudice to the general prohibition on linking to your account or to any World Rugby platform or website without World Rugby’ prior consent, you may not use any meta tags or any other "hidden text" using World Rugby’ name or trade marks without the express written consent of World Rugby. You may not use the words "World Rugby”,  “Rugby World Cup", “RWC”, “WRWC”, “Women’s Rugby World Cup”, “World Rugby fan account” “SVNS”, “Rugbypass” or any such other similar words or phrases or any world or phrases which are registered trademarks of World Rugby (or any derivations thereof) or any World Rugby logo or other proprietary graphic or trade mark as any button or link to your account or any World Rugby website or platform without express written permission from the appropriate owner in each case.

You agree to use your fan account only for lawful purposes, and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment by: others of their accounts or use of the World Rugby websites or platforms, World Rugby and/or any third party. Such restriction or inhibition includes, without limitation, conduct which is unlawful, or which may harass or cause distress or inconvenience to any person and the transmission of obscene, defamatory or offensive content or disruption of normal flow of dialogue from within your account.

You do not acquire any ownership rights to your fan account. Any unauthorised use of your account by you terminates the permission or licence granted to you in relation to your use of the account and shall constitute a clear and material breach of these Terms.

Disclaimer
Although we take reasonable care to ensure that the information and data accessed via your fan account is accurate at the time of publication, information displayed within your account is for general information purposes only and no representation or guarantee, expressed or implied, is made as to accuracy, reliability or completeness of information or content provided by World Rugby. You agree that World Rugby shall have no liability (including any resulting damage to you or a third party) or responsibility for any information or content contained on or accessed via your account which is incomplete, inaccurate or outdated. You specifically acknowledge that your account enables access to a high speed news and information service for publishing scores, news and other information and due to the short time span between the occurrence of an event and its reporting or publishing via your account, it is possible that inaccuracies may occasionally be published. World Rugby is not responsible for the content of external internet websites that link to your account or to any World Rugby website or platform which are linked from it.

To the maximum extent permitted by law, World Rugby accepts no responsibility for loss which may arise from your accessing of or reliance on information or opinions contained in or via your account and World Rugby assumes no liability for the use or interpretation of information or opinions contained herein. Your access to and use of your fan account is on an "AS IS" and "AS AVAILABLE" basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to (to the extent permitted by law) implied warranties of satisfactory quality, suitability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. To the maximum extent permitted by law, in no event will World Rugby be liable for any damages including, without limitation, indirect or consequential damages, or any damages whatsoever arising from your use of your account or any information or material contained therein or loss of connectivity, data or profits, whether in action of contract, negligence or other tort action, arising out of or in connection with your creation and/or use of your account.

World Rugby does not warrant that the functions, services and facilities contained or provided by the fan account will be uninterrupted, timely, secure or error free, that defects will be corrected, or that your account or the server that makes it available are free of viruses, bugs, spyware, malware or similar flaws or represent the full functionality, accuracy, and reliability of the materials. The names, images and logos identifying World Rugby or third parties and their products and services are proprietary marks of World Rugby and/or the third parties. Nothing contained herein shall be construed as conferring by implication any licence or right under any copyright, trade mark or patent or other intellectual property of World Rugby or any other third party.

Any material downloaded or otherwise obtained through the creation or use of your fan account is done at your own discretion and risk and you will be solely responsible for any damage to your computer system or device with which you access your account as well as for any loss of data that results from the download or use of any such material. You should ensure to have in place your own anti-virus software in relation to any information or materials you access, use or download via your account.

You acknowledge and agree that the views of the editorial team published on or accessed via your fan account are not the views of World Rugby or of its officers and directors.

Adverts may be published within your account from time to time in the form of buttons, banners, interstitials, pop-ups or other forms of online advertising on behalf of official partners and/or third party advertisers. World Rugby is not responsible for the content of such adverts and accepts no liability in relation to any representations made therein or any losses of any kind scope or nature arising in reliance thereupon.

Links From the Website
Links to third party websites from your fan account are provided solely as a convenience to you. If you use these links, you may leave your account and the website or platform that you are visiting at the time. You acknowledge and agree that World Rugby has no responsibility for the accuracy or availability of information, material, advertising, products, content, services or other items provided by or included within third party linked websites, access to and use of which may be governed by the terms applicable to such third party website. Links to such websites do not constitute an endorsement by World Rugby of such websites or the content, products, or other materials or services presented on such websites. Information in the many web pages that are linked to your account or any World Rugy websites or platforms accessed while using your account, and the applications and services available through your account, come from a variety of sources. World Rugby does not author, edit, or monitor the content, links, or services provided by third parties. TO THE MAXIMUM EXTENT PERMITTED BY LAW WORLD RUGBY SHALL NOT BE RESPONSIBLE OR LIABLE, DIRECTLY OR INDIRECTLY, FOR ANY DAMAGE OR LOSS CAUSED OR ALLEGED TO BE CAUSED BY OR IN CONNECTION WITH USE OF OR RELIANCE ON ANY SUCH CONTENT, PRODUCTS, OR OTHER MATERIAL AVAILABLE VIA YOUR FAN ACCOUNT OR ON THIRD PARTY LINKED WEBSITES. IF YOU DECIDE TO ACCESS ANY OF THE THIRD PARTY WEBSITES LINKED TO  YOUR FAN ACCOUNT, YOU DO SO ENTIRELY AT YOUR OWN RISK.

Links To the Website
We do not permit links to your account or to any World Rugby websites or platforms (including hyperlinking or so-called "deep links" to pages of the Website other than the homepage) without our prior written permission.

You acknowledge and agree that World Rugby has no responsibility for any links to your account or World Rugby websites or platforms that have been included on third party websites.

Third Parties
World Rugby does not itself supply any paid services or paid-for subscription services. These may be supplied by third parties whose websites will be governed by their own terms and conditions.

Contributions
If you submit any contribution to World Rugby via your account (including without limitation any text, graphics, photo, video or audio) you agree that by such submission you are granting World Rugby a perpetual, royalty-free, non-exclusive, sub-licensable and transferable right and license to use, reproduce, modify, adapt, translate, create derivative works from, publish, distribute, broadcast, transmit, communicate to the public, perform, play, and exercise all copyright, database rights, publicity rights and other intellectual property rights with respect to any such work worldwide and/or to incorporate it in other works in any media now known or hereinafter developed for the full term of any rights that may exist in such content and the privacy restrictions set forth in your fan account Privacy Policy shall also be applicable. If you do not wish to grant such rights to World Rugby, it is suggested that you do not submit your contribution to World Rugby. You also waive irrevocably on a perpetual basis (or, where such waiver is not permitted under the laws of any jurisdiction, agree not to enforce) any moral rights or rights of paternity which may exist in your contributions.

By submitting your contribution via your fan account, you also warrant that such contribution (a) is your own original work and that you have the right to make it available to World Rugby for all the purposes specified above, (b) is not defamatory and (c) does not infringe any law or the rights (including intellectual property rights) of any third party.

Privacy / Personal Data
We are firmly committed to safeguarding your personal data when you use your fan account. Please see the fan account Privacy Policy in this regard. In addition to your acceptance of these Terms, you acknowledge that you have read and understood the policy referenced above.

E-mail Service
In situations where we may give you the option to subscribe to any e-mail service which will update you with news or information which it considers to be of interest to you, your receipt and/or use of the content received through the e-mail service will be subject to these Terms.

Children under 16
If you are under 16, you must obtain the approval of your parents or a guardian before you:

• Create a fan account
• E-mail any World Rugby website or platform, or ask World Rugby to e-mail anything to you;
• Send in any information via your account or via any World Rugby website or platform;
• Enter any contest or game that requires information about you or offers a prize;
• Purchase anything online. Please note that certain purchases (for example, ticket purchases) may be subject to additional or supplemental conditions, including in relation to higher age restrictions.

 

By continuing to use your fan account and any of the services offered, you are confirming that you have received the consent of your parent or a guardian. We may request at any time evidence in writing from you, or carry out and action verification activities ourselves, for the purposes of confirming that guardian or parental consent has been obtained and if we have reason to believe that such consent has not been provided, we may terminate and/or suspend the u16’s access to their account and/or remove or delete their account.

The relevant parent or guardian shall remain responsible at all times for the u16’s compliance with these Terms.

No Confidential Information
We do not want to receive confidential or proprietary information from you through your fan account. Please note that any information or material sent to us via your fan account will be deemed NOT to be confidential. By sending us any information or material, you grant World Rugby an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, and you also agree that we are free to use any ideas, concepts, know-how or techniques that you send us for any purpose including in accordance with the fan account Privacy Policy.

Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW WORLD RUGBY WILL NOT BE LIABLE TO ANY PARTY FOR ANY DIRECT, INDIRECT, SPECIAL OR OTHER CONSEQUENTIAL DAMAGES OR COMPENSATION FOR ANY USE OF OR RELIANCE UPON YOUR FAN ACCOUNT OR ANY CONTENT OR MATERIALS CONTAINED THEREIN (OR ON ANY WORLD RUGBY WEBSITE OR PLATFORM ACCESS VIA YOUR FAN ACCOUNT) BY A USER, FAN OR REGISTRANT, OR ON ANY OTHER HYPER LINKED WEB WEBSITE, INCLUDING, WITHOUT LIMITATION, ANY LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR OTHER DATA ON YOUR INFORMATION HANDLING SYSTEM OR OTHERWISE, EVEN IF WORLD RUGBY IS EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You acknowledge and agree that your creation, use of and reliance upon your fan account is your sole responsibility. The protection of your own data, equipment and/or software from trojan horses, viruses, malware, bugs, worms and other forms software-related issues is entirely your responsibility.

Nothing in these Terms shall operate to limit or exclude either party’s liability to the other for death or personal injury caused by its negligence, any fraud or fraudulent misrepresentation or any other liability that cannot be limited or excluded by law.

Indemnity
As a condition of use the fan account, you agree to indemnify World Rugby, including its affiliates, officers, employees and agents from and against any and all liabilities, other expenses (including costs and legal fees) and damages arising out of claims resulting from your use of your fan account.

Security
If you communicate with World Rugby by e-mail or other digital means, you should note that the security of Internet e-mail is uncertain. By sending sensitive or confidential e-mail messages to us, including via your fan account, you accept the risks of such uncertainty and possible lack of confidentiality over the Internet.

Termination and Suspension
We reserve the right at all times to terminate and/or suspend, upon notice to you and for any reason, including for your violation or breach of any of these Terms, your licence, right and ability to access and/or use your fan account. We may also terminate or suspend your use of or access to the fan account if you lose or suffer theft of your World Rugby fan account details in order to protect the security of the Website and other users and fans.

General
If any of these Terms (or part thereof) should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these Terms are intended to be effective, then to the extent and within the jurisdiction which the relevant term is illegal, invalid or unenforceable, it shall be severed and deleted from this clause and the remaining Terms shall survive, remain in full force and effect and continue to be binding and enforceable.

The section headings and captions to the provisions within these Terms are inserted for convenience of reference purposes only and shall not be considered a part of or affect the construction or interpretation of these Terms.

If there is any conflict between these Terms and/or specific terms appearing elsewhere on your fan account relating to specific material, services or functions of your account, then the latter shall prevail.

These Terms shall be governed by and construed in accordance with the laws of England and Wales without regard to conflicts of law principles. All disputes arising in relation to these Terms, including in relation to validity, interpretation and execution shall be subject exclusively to the jurisdiction of the courts of England and Wales.
